CS FOR HOUSE BILL NO. 137(JUD) was before the Senate on

Senator Taylor moved and asked unanimous consent that CS FOR                   
HOUSE BILL NO. 137(JUD) be returned to second reading for the                  
purpose of a specific amendment, that being Amendment No. 1.                   
                                                                               
Senator Duncan objected, then withdrew his objection.  There being             
no further objections, the bill was returned to second reading.                
                                                                               
Senator Taylor offered Amendment No. 1 :                                        
                                                                               
Page 2, line 25, following "days":                                             
	Insert "and has served at least one-half of the prisoner's term               
less any good time earned under AS 33.20.010"                                  
                                                                               
Page 2, line 28, following "illness":                                          
	Insert ", is physically incapacitated, and is expected to                     
remain physically incapacitated throughout the entire period of                
special medical parole"                                                        
                                                                               
Page 3, following line 11:                                                     
	Insert a new subsection to read:                                              
	"(d)  Notwithstanding AS 33.16.150, a person                                 
released on special medical parole is only entitled to remain                  
on parole while the person is suffering from a terminal                        
illness and is physically incapacitated.  If the condition of                  
a person released on special medical parole improves so that                   
the person is no longer suffering from a terminal illness or                   
is no longer physically incapacitated, the board shall revoke                  
the person's parole and require the person to serve the                        
remainder of the person's sentence.  If a person's parole is                   
revoked only under this subsection, the board shall credit the                 
person's term with the time served on special medical                          
parole."                                                                       
                                                                               
Senator Taylor moved and asked unanimous consent for the adoption              
of Amendment No. 1.  Senators Adams, Duncan objected.                          
                                                                               
Senator Kelly called the Senate.  The call was satisfied.                      
                                                                               
Senator Taylor moved and asked unanimous consent that CS FOR                   
HOUSE BILL NO. 137(JUD) be returned to the Finance Committee                   
with pending Amendment No. 1.

Senator Pearce objected, then withdrew her objection.  There being             
no further objections, CS FOR HOUSE BILL NO. 137(JUD) was                      
returned to the Finance Committee with pending Amendment No. 1.
